Acceptable Use Policy

At The Gabriel Method, we are committed to helping you enjoy the process of transforming yourself into a naturally thin person. To help us help you in your goal of sustainable weight-loss, we provide a range of Electronic Services including a Forum, which is an online community through which users can share and support each other. If you wish to participate in our Electronic Services and be part of this community, you must abide by this Acceptable Use Policy (Policy), our Privacy Policy and any other rules or policies applicable to our Electronic Services, as varied by us from time to time.

  1. You:
    1. agree that you will be bound by this Policy;
    2. warrant that material you provide to us or upload or send to or through our Electronic Services (Content), including your contact details, is accurate and not misleading; and
    3. warrant that your Content and any use of your Content by us, or by other users of our Electronic Services in accordance with this Policy, will not infringe or cause the infringement of the rights of any person (including intellectual property and confidentiality rights).
  2. You must:
    1. only use our Electronic Services for the purpose they have been provided, that is, to access or post information regarding The Gabriel Method, and submit information, success stories, suggestions, ideas, comments and questions (Purpose);
    2. only use our Electronic Services for your personal, non-commercial use;
    3. ensure that your Content, if classified, would have a rating of no more than PG; and
    4. indemnify us and our officers, employees, agents, contractors and advisors against all claims, loss or damage suffered (including indirect and consequential loss or damage and all legal expenses) as a result of your breach of this Policy or otherwise arising from your Content.
  3. You must not engage in any prohibited conduct (Prohibited Conduct) in connection with our Electronic Services (whether by sending, uploading or otherwise making your Content available through our Electronic Services or using our Electronic Services to encourage or assist a person to carry out Prohibited Conduct outside our Electronic Services). Prohibited Conduct includes:

    1. conduct that is unlawful, obscene, profane, sexually explicit, defamatory, vilifying, racist, threatening, harassing, abusive, tortious, unlawfully discriminatory, offensive, objectionable or inappropriate, or might cause harm of any kind to any person or to The Gabriel Method or which might encourage illegal activities or other Prohibited Conduct, including posting Content about a user that is untrue, unverified, unfair, malicious, rumor, gossip, innuendo or unrelated to the Purpose;
    2. asking for personal information from people under the age of 18 or the passwords or personal identifiers of any other person;
    3. doing anything illegal or sending or uploading any information or material that is not yours (including confidential information of any person);
    4. false or misleading behavior including fraudulently or otherwise posing as another person, a representative of The Gabriel Method or any other entity or as having a connection with a person, entity or group that you do not have;
    5. sending, uploading or making available any prohibited content (Prohibited Content);
    6. infringing the privacy of another person;
    7. transferring your account or letting any other person use your account, username or password for our Electronic Services;
    8. using or trying to use the account, username or password of another user;
    9. gaining or trying to gain unauthorized access to or interfere with the performance of the computer systems or telecommunications systems and links that support our Electronic Services or of other Forum users;
    10. sending multiple copies of the same or substantially similar messages, large messages or files to us or other users or posting a large number of messages (whether to disrupt a service or account or for some other reason);
    11. hiding the origin of any material transmitted to or through our Electronic Services (including by forging message or packet headers); and
    12. collecting information, material or data about any other user (whether aggregated or otherwise) except for the Purpose.
  4. Prohibited Content is determined by us, in our sole discretion, and includes but is not limited to:

    1. Content that infringes the intellectual property of other people;
    2. false, misleading or deceptive Content;
    3. Content that if classified in Australia would be classified M, MA, R, X or refused classification;
    4. Content that can be taken as or causes, encourages or promotes Prohibited Conduct;
    5. Content that contains viruses or code designed or intended to disrupt, impair, harm or destroy the performance of any hardware or software belonging to any other person;
    6. Content that contains or is associated with spam, junk mail, chain letters, bulk unsolicited messaging, unauthenticated virus warnings or any form of unauthorized advertising or promotional material, including links to a third party website or other Content that suggests we endorse that particular third party;
    7. Content that contains a political agenda;
    8. Content that is not in English;
    9. Content that can only be accessed using some other Content such as a password or code or that is not linked to from another page within our website; and
    10. other illegal Content, including content that describes or otherwise incites criminal activity.
  5. We may remove, withhold, edit, rephrase and monitor any material you submit to our Electronic Services without any notice to you. You waive any rights you may otherwise have against us in relation to such removal or modification.
  6. We are under no obligation to protect, store, retrieve or return to you any Content or feedback that you or any third party posts or uploads to our Electronic Services.
  7. You acknowledge and agree that:

    1. we may investigate all actual or suspected breaches of this Policy, take legal action and refer any suspected offenders to relevant authorities;
    2. we may vary the Policy at any time without notice by posting the updated policy on our website. Please be sure to regularly check our website for any changes; and
    3. we may terminate the access of any user or third party to our Electronic Services at any time, including as a result of a breach of this Policy, without notice or liability.
